1. Agreement and scope
These Terms of Service ("Terms") govern use of the PaceSpace: Run, Walk, Bike mobile application ("PaceSpace", "the App", "we", "us", or "our"). The Operator is the legal person identified in the App's applicable store listing and the published Privacy Notice. By choosing Accept and continue in the App, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not use the App.
The Privacy Notice explains data processing, Product Analytics, and optional choices. It is incorporated by reference only to the extent applicable; it does not remove any mandatory consumer or data-protection right.
2. Eligibility
PaceSpace is for people aged 18 or older. During onboarding, you must make an 18+ self-declaration. The App does not ask for or store your date of birth. Do not use the App or make this declaration if you are under 18 or cannot validly accept these Terms.
3. What the App currently does
PaceSpace is a walking, running, and cycling app that records user-started outdoor exercise sessions. It can access location, physical-activity, accelerometer, gyroscope, and pedometer data to validate movement and create route, distance, speed, duration, and estimated calorie information. It can retain a live session draft to recover an interrupted recording and display a map, charts, metrics, and a local history. The user-selectable bicycle mode uses three-times visual speed-zone boundaries, GPS-led higher-speed movement validation, and speed-banded cycling MET values for a non-medical active-calorie estimate. The selected mode is retained in the active draft and completed local history.
The App is local-first. It can show an ordered, versioned launch-story
sequence once and store whether that version was completed or skipped. It can
store reusable workout plans, scheduled local
walk/run appointments, their local reminder choices, and a device-wide
workout-reminders switch in Settings. Disabling that switch cancels pending
device-local reminder schedules. On supported Android versions, the App may also
request the operating system's special exact-alarm access to improve reminder timing.
A planned appointment can retain no reminder
choices; saving it then does not request notification permission or schedule a
reminder for that appointment. Planned workouts also offer independent voice-
and default-on vibration-guidance settings. On Android, enabled vibration
guidance uses the existing local-notification system to request a one-second,
soundless vibration and transient notification at each plan-step start and at
workout completion; system settings may suppress it and failure does not stop
the workout. It provides no accounts,
remote activity backup or sync, friend or invitation features, or
medical coaching. It does not automatically transmit your local exercise data.
Height and weight are not required during onboarding. When they are missing, the App may invite you before an exercise
to provide them for a better calorie estimate. You may continue for now, suppress future invitations on that device, or
enter the measurements. The measurements and suppression choice remain in local App storage and are not required to
use the exercise-recording functions.
You can deliberately delete an activity or one occurrence from a recurring
planned appointment, remove a whole planned appointment group, reset settings, delete all App data,
paste or explicitly select a local JSON import, or export selected local
categories through the system share sheet or to the user-visible
Documents/PaceSpace directory. After an exercise, you can deliberately open a
system share sheet or save a generated image to your device gallery. The
default-on Show route control can omit the route and its start/end markers
from that generated image. A recipient is selected by you in the
operating system; PaceSpace does not create a social account or post to a
service on your behalf.
The App requests missing notification permission during exercise preparation for its ongoing
exercise notification, and may request it when saving a planned activity with a reminder choice.
Refusal does not prevent recording, but Android may hide the notification from the notification drawer.
It is not requested on Home or after exercise completion. Android exact-alarm access is tied only to
that reminder-scheduling action. A user-started active exercise uses a
location foreground service;
Android may show its visible notification throughout recording, including while
the exercise screen is not visible. Its notification can offer pause, resume,
and finish controls. Pausing stops location and motion sampling; ending removes
the service. The App does not request Android's ACCESS_BACKGROUND_LOCATION
permission. On iOS, the App configures Core Location background updates only
for an active exercise that you started, including while the screen is locked;
it does not start a new exercise or location recording in the background.
Premium subscriptions on Android
Google Play handles subscription purchase, eligible trials, charges and renewal. The App shows the eligible store price, currency and billing phases before you open Google's purchase confirmation. A trial becomes a paid subscription under the terms shown in that confirmation unless renewal is cancelled in time. The launch catalogue uses monthly USD 4.99 and annual USD 49.99 reference prices; the first-year annual launch offer is USD 33.49 where offered, through 15 November 2026 (23:59:59 Europe/Istanbul). Regional prices and taxes may differ. After the introductory year, the annual subscription renews at the regular price shown by Google Play. Eligible 14-day trials are controlled by Google Play, not by installation date. The previous additional-three-month proposal is not offered.
Custom plan creation, editing, duplication, selection and use, and exercise reminders, require current Premium access. The reminder creation + action checks access before opening the editor. When access ends, saved records and reminder selections are retained but their Premium functions are disabled. Restoring access makes those records usable again, subject to device notification permissions and your preferences. Free exercise and the built-in free plan remain available. An already started workout is not interrupted solely because Premium access changes.
Use Manage subscription to open Google Play and cancel renewal. Cancelling renewal normally leaves access until the paid period ends. Refund requests are governed by Google Play's applicable policies and your mandatory consumer rights; cancellation is not a promise of a full refund. Deleting App data or uninstalling does not cancel billing. Use Restore purchases with the Google account used to subscribe.
The App checks current access and purchased plan through Google Play and the first-party PaceSpace verification API. An unavailable check is not proof of expiry. Offline continuation and locally scheduled reminders are limited to a seven-day window following a successful access check within the same App process; a failed check does not extend this window. A successful inactive result cancels pending and displayed exercise reminders. Reopening requires a store check. Notification delivery is not guaranteed, and uninterrupted reminders require periodic App use and successful checks. An offline device or a cached store result can delay revocation. The App does not show an invented expiry date or refund reason.
4. Your device, permissions, and choices
You control operating-system permissions. Location and motion access are needed for the corresponding recording functions; declining or later withdrawing them can prevent a session from starting or continuing accurately. On Android, the App always explains physical-activity access before opening the system prompt. Not now skips the system prompt and allows the explanation to return during the next preparation. A declined system request is also offered again next time. Don't ask again stores a device-local preference that suppresses automatic explanations. The App has no separate Permissions settings page or location/activity permission controls. You can grant, review, or revoke operating-system permissions directly in your device settings. Resetting the App's settings clears the Don't ask again choice. Declining motion access or dismissing or suppressing the explanation limits motion verification but does not block the countdown once usable GPS samples are available; GPS tracking continues. Declining location access can block preparation and route recording. You are responsible for reviewing device settings, battery behaviour, connectivity, and the visible Android foreground-service notification when you record an exercise.
You must provide accurate information where you choose to provide it, use the App lawfully, and not interfere with its security, maps, sensors, or service operation. You may not reverse engineer, misuse, disrupt, or use the App to track another person without a lawful basis and their permission.
5. Health and safety notice
PaceSpace is a fitness-recording tool, not a medical device, emergency service, diagnostic tool, or substitute for professional medical advice. Distance, speed, route, movement validation, and calorie values are estimates and can be wrong because of sensor accuracy, environment, device settings, or software limitations. Do not rely on the App for safety-critical navigation, emergency response, medical, dietary, or treatment decisions.
Exercise only when it is safe for you. Stop if you feel unwell, comply with traffic and local rules, and seek qualified advice about exercise or health concerns. In an emergency, contact local emergency services instead of relying on the App.
6. Local data and backups
The App stores its settings, profile choices, saved workout plans, activity drafts, completed
activity records, scheduled appointment/reminder choices, route points, metrics,
and optional map preview in its local
application storage. A completed activity remains there until you remove the
App's data through your device controls or uninstall the App, subject to your
device platform's behaviour. You may remove saved workout plans from the plan
library; this does not remove plan snapshots held by active or completed
workouts. You can delete individual completed activities. Reset settings removes
settings, the completed launch-story version, profile, plans, reminders, and local consent choices while retaining
completed history; Delete all App data removes the local records held by the
App. Export creates a JSON document with only the categories you check and, at
your choice, hands it to the system share sheet or saves it in the user-visible
Documents/PaceSpace directory. Import reads only JSON you paste into the App
or explicitly select through Android's system file picker and replaces only
included local categories. You can separately save a generated activity image
to the device gallery; that output is outside App
storage and may remain after you delete App data or uninstall, subject to
device-platform behaviour. The 18+ declaration, Privacy Notice acknowledgement,
Terms acceptance, their evidence, and the Product Analytics preference are
never exported or imported; a legacy permissionsAndPrivacy import category is
ignored. The device-local choices to suppress automatic physical-activity permission explanations or the optional
height/weight invitation are also not exported or imported. These tools do not
create cloud backup, account recovery, or remote sync.
Android automatic app backup and device-to-device restore are disabled by this App. You are responsible for keeping your device secure and for any loss of locally stored activity information. See the Privacy Notice for the full data description and limits of the App's local storage safeguards.
7. Third-party services and connectivity
Android version verification and updates
Before any successful Android version check, choosing Not now permits new workouts for one 15-day period starting with that choice, stored on the device. Retries and restarts do not extend it. After it expires, online verification is required. A successful signed check takes precedence, including a mandatory update. This local period is not tamper-proof. While the app is in use, checks normally occur once per 24 hours. Unsupported builds, an announced update deadline, or 15 days after choosing Not now for a recommended update prevent starting new workouts. After 15 days without successful verification, reconnect and verify before starting a workout. Existing workouts may be finished and saved; history, export and help remain accessible. Connectivity or service outages can prevent verification. Installation uses Google Play after user action; availability depends on the store and device. Clearing OS app data or reinstalling restores the first-use choice. This update requirement is separate from optional analytics.
Launch stories and PaceSpace Announcements retrieve first-party product content and images from the PaceSpace website over HTTPS. Availability requires a working connection; a failed launch request does not block normal use. A completed group may be replayed manually; replay does not change its saved completion version or produce launch-story telemetry. The current sequence contains no enabled external destination. A later authorised version may present a separate visible action that discloses its host and opens only a fixed allow-listed HTTPS URL after your tap in the system browser. The App does not append user, device, profile, activity, consent, progress, measurement, or attribution data. The destination may apply its own terms and privacy notice. “News” excludes a general or third-party news feed, not these local first-party product announcements. Advertising, sponsored content, targeting, attribution, or a new recipient requires a new product and legal review.
Map display requests map tiles from OpenStreetMap. When configured, Sentry automatically receives only a sanitized technical error event when an unhandled or handled application error occurs: exception type/module, safe stack symbols, line/column metadata, release/environment, timing, platform, and a fixed error-source label. The App drops exception text or values, workout/profile/route data, user/request fields, contexts, extras, breadcrumbs, paths, variables, screenshots, replay, transactions, and performance traces. This is an application-level filtering boundary; Sentry or a network provider may still process ordinary transport metadata, such as an IP address, under its configuration. When you press Send report, Sentry separately receives the user-selected Help or Report-an-issue category and up to 250 characters of text you enter. The support input warns you not to include location, health, or identity information; you are responsible for the content you choose to submit. If configured Sentry delivery is unavailable on Android, the App can open a support email draft addressed to the release-configured Operator contact; you remain in control of sending or cancelling it in your email application. Optional product analytics may use PostHog's EU ingestion endpoint only after your separate opt-in. Those services, network access, and your device platform are outside our direct control and may have their own terms and notices. The App's data practices and the limits on what it sends are described in the relevant notices.
8. Intellectual property and limited licence
Subject to these Terms, we grant you a personal, revocable, non-transferable, non-exclusive licence to use the App on a device you control. The App, its branding, design, and software are protected by applicable intellectual property laws. Except for this limited licence, no rights are granted.
Your locally stored exercise data remains yours or under your control as required by law. You grant us no licence to sell, publicly display, or commercially exploit it merely by using this local-first App.
9. Availability, changes, and suspension
The App and third-party map availability may be interrupted, inaccurate, or changed. We may update, secure, repair, or discontinue features when reasonably necessary. We will not use a Terms update to silently authorise a new, materially more intrusive data practice. Such a change requires the documentation, in-App disclosure, consent, and legal review required by the Legal Documentation Maintenance Rules and applicable law.
We may suspend use where reasonably necessary to protect users, comply with law, address security, or stop misuse. Mandatory consumer rights remain unaffected.
10. Disclaimers and liability
To the fullest extent permitted by law, the App is provided "as is" and "as available." We do not promise uninterrupted service, sensor accuracy, map accuracy, fitness results, compatibility with every device, or preservation of local data. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including non-waivable consumer rights.
11. Changes to these Terms
We may update these Terms for legitimate reasons, including legal, security, feature, or product changes. The published version identifies its update date. For a material change, we will provide notice and, where required, obtain a new acknowledgement before applying it. Continuing to use the App after a properly notified, lawful update may constitute acceptance where applicable law permits.
12. Contact and governing rules
For support, legal notices, or questions, use the Operator contact published in the applicable store listing and Privacy Notice. Any governing-law, jurisdiction, or dispute-resolution provision must be added to the published version only after the Operator has selected it with qualified legal advice. Until then, mandatory law and consumer protections that apply to you continue to apply.
